MEMBERSHIP
A member, after joining the Employers Organization in association with the company can become a member of the scheme at a fixed monthly subscription fee.


DETERMINATION OF SUBSCRIPTION FEE

The subscription fee is calculated in accordance with the following variables, viz:

• Number of employees of the member to be covered.
• The risk factor per sector of operations, i.e.: Manufacturing, Construction, Commercial,
- Mining Services.
• The risk factor per area of operations, i.e.: Gauteng, Free State, North West Province,
- Northern Cape etc.
• Union involvement at the members’ business concern.
• Distance from the company’s offices.
• Number of Traffic Violations in last two years.
• Type of Traffic Violation.
• Number of registered vehicles on company's name.
• Number of labour disputes declared against the member in the Labour Court, Mediation,
- Arbitration and Conciliation (C.C.M.A) and other interactions.
• Risk factor regarding in-company labour and traffic management

CONTRACTUAL ARRANGEMENT

A contract is entered into and between the company and the member. This contract clearly stipulates the pre-requisites to be adhered to by the Member and the company, the services rendered by the company and the subscription fee.

A Membership Certificate is issued and endorsed accordingly by the company to the Member in conjunction with membership certificate of the Employer’s Organization in association

BENEFITS OF THE SCHEME

The benefits of the Labour Relations and Traffic Risk Management Scheme include the following:

- Representation in the C.C.M.A (Conciliation & Arbitration) and Bargaining Councils.
- Drafting of Labour court Litigation Documents.
- Negotiating with Unions regarding wages and other conditions of employment,
- redundancy, retrenchment and recognition
- agreements.
- Paying of awards (CCMA and Bargaining Councils) as well as costs orders in the
- CCMA/Bargaining Council/Labour Court out of the legal cost
- insurance , once the member joins the insurance scheme.
- Chairing and / or attending to Disciplinary Enquiries and / or Appeal Hearings.
- Representations of cases related to Traffic Violations.
- Assistance with licensing problems.
- All other services as mentioned under Traffic & Licensing section except where cost is
- involved payable to attorneys or according to any act of the
- Republic of South Africa or as stipulated in clause 8 of the Membership Agreement
- entered into.
- Providing Labour Relations documentation Contracts and Recognition Agreements
- defined in the Membership agreement
- All costs regarding the above, except for exclusions as stipulated in clause 8 of the
- Membership Agreement between the company and the Member is
- borne by the company. In other words, the Member only pays his monthly subscription fee and is not exposed to any other costs.

4.5 LABOUR RELATIONS AND TRAFFIC MANAGEMENT SERVICE

Should the member not accept the Labour Relations and Traffic Risk Management Scheme and wishes to test the company’s ability on an hourly rate, or on ad-hoc basis, prior to opting for the Labour Relations and Traffic Risk Management Scheme, we will discuss a fee separate for every services delivered by our company as set out in PAR 6. (six) of the prospectus.
